TERMS AND CONDITIONS OF SALE – ONLINE SERVICES

ARTICLE 1 – Scope

These Terms and Conditions of Sale (hereinafter the “Terms”) apply, without restriction or reservation, to any purchase of the following services:

Online website vulnerability detection service,
as offered by the Service Provider to non-professional clients (hereinafter the “Client” or “Clients”) on the website https://www.cerbere3s.com.
The key features of the services are detailed on the aforementioned website.

The Client is required to read these Terms prior to placing any order. Selecting and purchasing a service is the sole responsibility of the Client.

These Terms are accessible at all times on https://www.cerbere3s.com and shall prevail over any other document.
By ticking the appropriate box prior to completing the online order process, the Client acknowledges having read and accepted these Terms.

Unless proven otherwise, the data recorded in the Service Provider's IT system constitutes evidence of all transactions concluded with the Client.

Customs duties or other local taxes, import duties or state taxes may be due and are the sole responsibility of the Client.

Beta phase of the service
Prior to the commercial launch of the service, C3S offers a free beta version allowing users to test the website’s features in an experimental setting.
This testing phase, estimated to last between one and two months, aims to evaluate and improve the service before its paid release.
During this period, no commercial transaction is carried out, and these Terms and Conditions of Sale apply for informational purposes only.
Users acknowledge that the service is provided “as is”, without any guarantee of availability, performance, or accuracy of the results, and that it may present certain technical limitations or temporary interruptions.
C3S shall not be held liable for any direct or indirect consequences arising from such limitations during the testing period.

ARTICLE 2 – Prices

Services are provided at the current prices displayed on https://www.cerbere3s.com at the time the order is placed.
Prices are in Euros, exclusive and inclusive of tax (HT and TTC).
Any applicable discounts offered by the Service Provider are reflected on the website.

Prices are fixed and non-revisable during their validity period. The Service Provider reserves the right to modify prices at any time outside of said period.

Prices do not include processing, shipping, or delivery fees, which are charged additionally and calculated prior to confirming the order.

The amount due includes all applicable costs. An invoice is issued and made available to the Client upon delivery of the ordered services.


ARTICLE 3 – Orders

It is the Client’s responsibility to select the services they wish to purchase via https://www.cerbere3s.com, as follows:

Account creation
Upon creating an account, the Client is entitled to one free scan, with all options enabled, to test the service prior to making a purchase. The following process applies only to paid services.

Ordering process
After logging in, the Client may select a subscription plan or purchase single scans. Optional features may be added at this stage.

A summary page displays the selected plan, applicable options, and the total price (TTC). The Client enters their payment details and confirms by clicking "Pay."

The order is only confirmed after payment validation by the secure payment provider.

Order confirmation
Once validated and paid, the Client will immediately receive a confirmation email including:

  • The selected service plan

  • Any enabled options

  • The total amount paid

  • Billing details

  • Subscription start date (if applicable)

  • A link to download the invoice

The invoice serves as proof of the transaction.

Payment
Payments are made online via secure card payment. Payment is required at the time of order.
No service will be provided without successful payment validation.

In the case of subscriptions, payments are automatically renewed unless cancelled by the Client before the renewal date.

The sale is only deemed final once full payment has been received. The Client must verify the order and report any errors without delay.

Any order placed on https://www.cerbere3s.com constitutes a remote contract between the Client and the Service Provider.

The Service Provider reserves the right to cancel any order from a Client involved in a prior payment dispute.

Order tracking is available on the website.


ARTICLE 4 – Payment Terms

The price is payable in full on the day of the order via: Secure card payment

Payment data is encrypted using the protocol provided by the authorized payment service provider.

Payments are deemed final only upon actual receipt by the Service Provider.

Services will not be delivered until full payment has been confirmed.


ARTICLE 5 – Service Delivery

The ordered services will be provided as follows:

Cybersecurity services are delivered remotely through the platform accessible at https://www.cerbere3s.com.

Once the order is confirmed and any required information (e.g., website URL, authentication credentials) is received, the vulnerability scan is launched either automatically or manually.

Results are provided via a downloadable digital report in the Client’s secure account.

Services will be delivered within a maximum of 1 day from the final confirmation of the order.

The Service Provider will make every effort to perform the services as agreed, within a best-effort obligation.

If services are not delivered within 7 days of the indicated date (excluding force majeure or Client delays), the Client may cancel the order in accordance with Articles L216-2, L216-3, and L241-4 of the French Consumer Code.

In such a case, the Client will be refunded within 14 days, with no additional compensation.

Special Client requests formally accepted by the Service Provider may incur additional charges.

In the absence of expressed reservations, the services are deemed to conform in quantity and quality.

The Client has 3 days from delivery to submit complaints by email or contact form, with supporting documentation.

No claim will be valid unless these conditions are met.

The Service Provider will refund or correct any proven non-compliant service at their own expense.


ARTICLE 6 – Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, for recurring services, the withdrawal period starts on receipt of the first delivery.

The right of withdrawal may be exercised online via the withdrawal form or any clear written statement, including by mail or email to the Service Provider (see Article 1).

If exercised within the applicable period, only the cost of the service will be refunded.

The refund will be processed within 14 days from receipt of the withdrawal notice.


ARTICLE 7 – Service Provider Liability – Warranties

The Service Provider guarantees the Client, free of charge and in accordance with the law, against any lack of conformity or hidden defects arising from faulty performance of the services.

Legal warranty provisions:

  • Article L217-4: The seller must deliver a product that conforms to the contract.

  • Article L217-5: Conformity criteria based on expected use and contractual agreements.

  • Article L217-12: Legal warranty is valid for 2 years.

  • Article L217-16: Warranty extension for repairs lasting over 7 days.

To exercise rights, the Client must notify the Service Provider in writing of any defect.

The Service Provider will refund or correct defective services as soon as possible and no later than 14 days after confirmation of the issue.

Refunds may be made via bank transfer or cheque.

The Service Provider's liability is limited to the amount actually paid by the Client.

The Provider cannot be held responsible for delays due to force majeure.

Services are compliant with French law. It is the Client’s responsibility to verify local legal compliance if ordering from abroad.


ARTICLE 8 – Personal Data

The Client is informed that personal data is collected and processed for the purpose of providing the services.

8.1 Data collected
During account creation and payment:

  • Name, address, phone number, email

  • Bank/payment details

8.2 Recipients
Personal data is shared only with parties involved in service execution:

  • Primarily: payment providers

8.4 Processing limitations
Personal data is not used for marketing unless the Client gives explicit consent.

8.5 Data retention
Data is stored for 5 years for legal and contractual liability reasons.

8.6 Security
Measures are in place to ensure data protection, but full security on the internet cannot be guaranteed.

8.7 Data subject rights
Clients may exercise rights (access, rectification, deletion, portability, objection) by contacting the Data Controller (see Article 9.3).
They may also contact CNIL or a judicial authority in case of refusal.


ARTICLE 9 – Intellectual Property

All content on https://www.cerbere3s.com is the exclusive property of the Service Provider and partners.
Any reproduction or use is strictly prohibited and may constitute infringement.


ARTICLE 10 – Governing Law – Language

These Terms are governed by French law.
The French version shall prevail in the event of a conflict with a translated version.


ARTICLE 11 – Dispute Resolution

For any complaint, contact customer service (see Article 1).

In case of dispute, the Client may use:

Disputes not resolved amicably will be referred to the competent courts in accordance with applicable law.
